USING THE SITE



The Providers are the commercial operators of the Site. However, software, hosting, content and other functions related to the operation of the Site may be provided by certain Providers' related entities (i.e., Wells Fargo, N.A. and its direct and indirect subsidiaries ("Wells Fargo Entities"), Providers' service providers ("Service Providers," e.g., contractors, vendors, distributors and service providers); and/or other third parties who are in a business relationship with Providers ("Business Partners", together with Wells Fargo Entities and Service Providers, the "Trusted Third Parties"). Trusted Third Parties are intended third party beneficiaries of this Notice.

Protecting your privacy is very important to us. Our goal is to treat the personal information you furnish us with the utmost respect and in accordance with this Notice, which we have prepared so that you will clearly understand our intended approach to your privacy and our methods of collecting and using information, consistent with our Terms of Use which controls in the event of a dispute related to your use of the Site.

This Notice applies to information gathered about and/or provided by visitors and registered users (together, "Users") of the Site, and governs all interactions with Providers through the Site and by email. It describes the type of information Providers collect from Users, what Providers do with that information, how it shares that information with its Trusted Third Parties, and how Users can update and control the use of information provided to Providers through the Site.

This Notice applies solely to online data collection through the Site. It does not describe information collection policies for data Providers may collect though other Web sites, such as separate sites operated by our Trusted Third Parties that we do not control.

WHAT INFORMATION DO WE COLLECT?



Anonymous Browsing/Cookies



When you visit our Site, we may place browser cookies on your computer. Browser cookies are small text files that our Web server automatically sends to your computer when you browse our Site. Browser cookies are stored as text files on your hard drive, and can be accessed by our Web servers when you return to our Site. Browser cookies automatically collect and send us non-personally identifiable information about your Site visit - for example, your computer's IP address, number of visits, average time spent, pages viewed, your navigation history through each Site, and other statistics. Some of our Business Partners use cookies on the Site with our permission. However, we have no access to or control over these cookies. This Notice covers the use of cookies only by Providers, and does not cover the use of cookies by our Business Partners.

Mobile



When you connect to us using a mobile application, we may use cookies or web beacons and other methods to customize your browsing experience. If you use any location-enabled products, you may be sending us location information. Providers do not store or use this information other than to provide the service or product you requested. For example, a mobile product may use GPS data to find a nearby retail location. Location-enabled features are opt-in and you have control over your participation and can turn these services off at any time.

Some mobile applications will utilize analytic tools to help us better serve you through improved products, services, and revisions to the mobile applications. This collected information does not include personally identifiable information and will not identify you to Providers. It may, however let us know anonymously, which services and features you are using the most within the application, as well as device type and hardware features, country, and language of download.

Personal Information Collection



You may only use the Site by registering and/or submitting the requested personally identifiable information. We ask you for information about yourself in order to assist us in meeting your various needs, including:
  • Providing, administering, and communicating with you about features, products, events, surveys, promotions, or services offered by Providers or our affiliates (including by sending you marketing communications);
  • Creating, administering, servicing, and communicating with you about your account (including any financing and payments);
  • Processing, evaluating, and responding to your requests, inquiries, and applications;
  • Protecting against and preventing fraud, unauthorized transactions, claims and other liabilities, and managing risk exposure and quality;
  • Conducting investigations and complying and enforcing applicable legal requirements, industry standards, or our policies and terms, such as this Notice and the Terms of Use;
  • Enforcing the safety of Providers' and its affiliates' network services, information resources, and employees;
  • Developing and/or informing you of other features or services that may be of interest to you; and
  • Verifying your identity to ensure security for the other purposes listed here.


When you use the Site you are not anonymous to us. To provide these services, we may ask you to provide, among other things, your name, postal address, e-mail address, telephone and fax number, responses to previously answered challenge questions to help us authenticate you, as well as billing and financial account information and other information concerning your business. In addition, you may elect to apply online for our features or services, which may require us to gather additional information to determine your eligibility for such features or services.

INFORMATION SHARING



When you provide us with personal information, we will use that information for the purpose for which we collected it - for instance, providing you with features or services, facilitating a transaction, servicing your account, and responding to your inquiries. We may also share your personal information with our Trusted Third Parties for the purpose of assisting us in the foregoing activities, and with the GE Entities so they may contact you directly about products or services they believe may be of interest to you. However, we will never share your personal information with non-affiliated third parties for marketing purposes. All of our Trusted Third Parties are under obligations to maintain the security and confidentiality of your personal information consistent with this Notice.

We may also disclose your personal information to third parties in response to a request by a law enforcement authority, when required or permitted by law or legal process, including a court order or subpoena, or when we believe disclosure is necessary to prevent physical harm or financial loss, or in connection with an investigation of suspected or actual illegal activity.

In addition, we may share aggregate, non-personal information (e.g., including without limitation, information collected by cookies; transactional information, account history, customer, vendor, distributor, and performance data) with our Trusted Third Parties. We cannot guaranty that aggregated, non-personal information shared with our Trusted Third Parties when combined and integrated with diverse data sets and subject to data mining and other kinds of analytics, whether existing now or in the future, may reveal new, non-obvious, unexpected uses of data and sometimes private and/or personal information either through inference, new insights, or re-identifying previously aggregated, anonymous information.

Finally, in the event any of the Providers is merged into another company, or another company acquires all or substantially all of any of the Providers' assets, including, without limitation, in the event of bankruptcy, your personal information may be among the items transferred in that transaction. In such event, your personal information will continue to be governed by this Notice subject to the Site Terms of Use or applicable provisions in documents evidencing credit accommodations between you and Providers.

By submitting personal information to Providers, Providers may transfer and store your personal data across national boundaries for purposes described in this Notice.

E-MAIL COMMUNICATIONS



Occasionally, we will send you e-mail communications in response to your information requests, account activity, questions you have asked, in connection with your use or access to the Site, account, or related to Site maintenance.  As applicable, we may also send you e-mail communications about products, services, information, data, reports, dashboards, or other materials we believe may be of interest to you given the context of our existing commercial relationship. By accepting the Terms of Use, you are expressly consenting to the receipt of such messages. You may, however, withdraw this consent for certain commercial electronic messages in the future by following the instructions in any such message or by contacting us at the appropriate address from the those listed below.

HOW DO YOU ACCESS AND UPDATE YOUR INFORMATION?



If you do business with Providers, we provide you access to information about your account(s) or transaction(s) by sending you periodic statements, invoices, providing you access to our Customer Online Management System, and by providing account representatives to answer your questions. To the extent that you decide to register or otherwise provide us with personally identifiable information or other commercial or financial information through the Site, you may want to update the information. In order to update your information you must contact us as described below to request changes or deletions to your personal information.

HOW IS YOUR INFORMATION SECURED AND PROTECTED?



Our goal is to protect your personal information submitted to us through this Site. We maintain physical, electronic, and administrative safeguards to protect your personal information from accidental, unauthorized or unlawful access, use, modification, disclosure, loss, or destruction. For general information on security measures employed by Providers and other useful information, please click on Security. We restrict access to information about you to those individuals who need to know the information in order to perform activities consistent with those stated in this Notice. We instruct our employees with access to your information that it is to be used only in adherence with the principles set forth in this Notice and the laws applicable to our business. Employees who misuse customer information are subject to disciplinary action.

Please note that information you send to Providers electronically is not necessarily secure when it is transmitted to us even after taking into account the security measures employed by Providers. If your communication is very sensitive or includes highly confidential information such as social security number ("SSN") or other national identifier, you may want to send it by means other than unsecured electronic methods. Providers strive to protect the confidentiality and security of SSNs or other national identifiers in our possession, custody, or control by employing reasonable safeguards seeking to: (i) restrict employee access to and use of SSNs or other national identifiers; (ii) prevent unauthorized third party access to the SSNs or other national identifiers; and (iii) prohibit unlawful disclosure of SSNs or other national identifiers.

Finally, no security measures, however thorough, are perfect. Accordingly, and as reflected in the Terms of Use, we do not guarantee or warrant the security of the information you provide to us.

OTHER INFORMATION COLLECTORS



This Notice addresses only the use and disclosure of information we collect online through the Site. Our Site may include links to the Web sites operated by our Trusted Third Parties. The privacy policies of those sites may be different from ours. When you leave our Site and disclose your personal information to third parties on other Web sites, you are subject to the privacy policies for those sites. We are not responsible for the content of third party privacy notices, or the privacy practices employed by any third parties.

INTERNATIONAL USERS



The Site is controlled, operated, and administered by Providers, and this Notice is provided in accordance with and subject to, the Site Terms of Use and applicable U.S. law for Users located in the U.S. and applicable Canadian law for Users located in Canada. Access to the Site is intended only for Users located within the United States or Canada. As reflected in the Site Terms of Use, PROVIDERS MAKE NO REPRESENTATION OR WARRANTY OF ANY KIND THAT USE OF THE SITE OUTSIDE OF THE UNITED STATES OR CANADA IS LAWFUL OR PERMISSIBLE. Those who access the Site from other jurisdictions are responsible for their compliance with local laws pertaining to their use of the Site.

WHAT IF WE CHANGE THIS NOTICE?



We may revise this Notice at any time. We encourage you to visit this page periodically to review our current Notice so that you will always know what information we gather and how we may use that information. In the event we make any material changes to this Notice, we will post a notice for at least 30 days following such change.
